Villa Reservations & Website Use

These Terms & Conditions govern the use of the website and the booking of holiday accommodation operated by BESO PRIVATE MEMBER PC. By making a reservation through our website or otherwise booking one of our villas, the guest confirms that they have read, understood and accepted these Terms & Conditions.

1. PROPERTY & COMPANY INFORMATION

The villas offered through this website are holiday accommodation properties located in Kefalonia, Greece.

The accommodation provider is:

Hereinafter referred to as the “Company”, “we”, “us” or “our”.

The person making a reservation is hereinafter referred to as the “Guest”, “you” or “your”.

2. BOOKINGS & CONTRACT

A reservation is considered valid and confirmed only once the Guest has paid a deposit equal to 40% of the total reservation price and the payment has been successfully received and confirmed by the Company.

The remaining 60% of the total reservation price shall be paid no later than the Guest's scheduled arrival date, unless a different payment arrangement has been expressly agreed in writing between the Guest and the Company.

The person making the reservation must be at least 18 years old and must have the legal capacity to enter into a binding agreement.

The person making the reservation is responsible for providing accurate and complete information and for ensuring that all members of their party comply with these Terms & Conditions.

A booking is made for both of specific villa, dates and number of guests stated in the booking confirmation. Any change to these details must be agreed with the Company in advance and may be subject to availability and additional charges.

 

3. RATES & PAYMENT

The total price of the reservation will be communicated to the Guest during the booking process or in the booking confirmation.

Unless otherwise expressly stated, the price includes the accommodation for the number of guests specified in the reservation.

Any applicable taxes, governmental charges, accommodation-related levies or other mandatory charges will be handled in accordance with the applicable laws and regulations in force in Greece.

A deposit of 40% of the total reservation price is required in order for a reservation to be considered valid and confirmed. The reservation shall not be considered guaranteed until the 40% deposit has been successfully received and confirmed in writing by the Company.

The remaining balance of 60% shall be paid no later than the Guest's scheduled arrival date, unless otherwise expressly agreed in writing by the Company.

If the required 40% deposit is not received within the required timeframe, the Company may decline to confirm or may cancel the reservation after notifying the Guest.

If the remaining balance is not received by the scheduled arrival date, the Company reserves the right to treat the reservation as unpaid and to take appropriate action in accordance with these Terms & Conditions and the applicable cancellation policy.

4. CANCELLATION POLICY

The following cancellation policy applies unless a different cancellation policy has been expressly agreed in writing for a particular reservation.

Cancellation 60 days or more before arrival

If the Guest cancels the reservation 60 days or more before the scheduled arrival date, the Guest will receive a 100% refund of the amount paid for the accommodation.

Cancellation between 20 and 59 days before arrival

If the Guest cancels the reservation between 20 and 59 days before the scheduled arrival date, the Guest will receive a 50% refund of the amount paid for the accommodation.

Cancellation 0–19 days before arrival

If the Guest cancels the reservation within 19 days of the scheduled arrival date, including on the arrival date or in the event of a no-show, no refund will be provided.

For the avoidance of doubt, the applicable cancellation period is calculated by reference to the scheduled date of arrival.

Refunds, where applicable, will be processed using the original payment method, subject to the processing times of the relevant payment provider or financial institution.

Any bank charges, transaction fees or non-refundable payment-processing charges may be deducted from the amount refunded where legally permitted and where such charges have been clearly communicated to the Guest.

5. CHANGES TO A RESERVATION

Any request to change the dates, villa, number of guests or other material details of a confirmed reservation must be submitted to the Company as soon as possible.

Changes are subject to availability and are not guaranteed.

A change of dates may be treated as a cancellation of the original reservation and a new booking, in which case the cancellation policy applicable to the original booking may apply.

The Company will make reasonable efforts to accommodate requests for changes but does not guarantee that they can be accepted.

6. CHECK-IN & CHECK-OUT

Our standard check-in time is from 12:00 noon onwards, and our standard check-out time is by 12:00 noon.

We aim to maintain a flexible check-in and check-out policy wherever reasonably possible.

Guests are encouraged to contact the Company in advance to agree their expected arrival and departure times. Early check-in or late check-out may be available depending on occupancy, cleaning schedules and other operational considerations.

Any agreed alternative check-in or check-out time is subject to prior arrangement and availability.

The Company cannot guarantee early check-in or late check-out unless this has been expressly confirmed in advance.

7. MAXIMUM OCCUPANCY & GUESTS

Each villa accommodates up to 6 guests in the standard sleeping accommodation.

A sofa bed may accommodate up to 2 additional guests, resulting in a maximum occupancy of 8 guests per villa.

The Guest must accurately state the total number of persons staying at the villa at the time of booking.

The maximum permitted occupancy must not be exceeded without the Company's prior written approval.

The Company reserves the right to refuse accommodation or require additional persons to leave the property if the maximum permitted occupancy is exceeded without prior authorization.

8. USE OF THE VILLA

The villa must be used solely for lawful holiday accommodation and private residential purposes.

Guests must use the property responsibly and with due care and respect for the property, its contents, surrounding properties and the local community.

The Guest must not use the villa for any illegal, commercial or unauthorized purpose.

The Guest must not sublet, assign, transfer or otherwise make the villa available to third parties without the Company's prior written consent.

9. PARTIES, EVENTS & EXCESSIVE NOISE

Unless expressly authorized in writing by the Company, parties, events, receptions, celebrations or gatherings involving persons who are not registered guests are not permitted.

Guests must respect the peace and quiet of the surrounding area and must not engage in activities that cause excessive noise, disturbance, nuisance or inconvenience to neighbours or other persons.

The Company reserves the right to take appropriate action, including termination of the stay without refund where legally permitted, in cases of serious or repeated disturbance or breach of these Terms & Conditions.

10. SMOKING

Smoking inside the villas is not permitted.

Guests are responsible for ensuring that cigarettes, tobacco products or other smoking materials are not used inside the property.

Any additional cleaning, damage, odor removal or other costs resulting from smoking inside the villa may be charged to the Guest where legally permitted.

11. PETS

Pets are not permitted unless expressly approved by the Company in writing prior to arrival.

Any approved pet must be disclosed at the time of booking and may be subject to additional conditions or charges.

12. DAMAGE, LOSS & EXCESSIVE CLEANING

The Guest is responsible for taking reasonable care of the villa, furniture, fixtures, equipment and other property provided during the stay.

The Guest may be held responsible for damage, breakage, loss or destruction caused by the Guest or any member of their party, except where such damage results from ordinary wear and tear.

The Guest must notify the Company as soon as reasonably possible of any damage, defect or malfunction discovered during the stay.

The Guest may also be responsible for reasonable additional cleaning costs resulting from unreasonable use of the property or cleaning requirements substantially beyond normal end-of-stay cleaning.

Where legally permitted, the Company reserves the right to seek reimbursement for reasonable and documented costs arising from such damage, loss or additional cleaning.

The Company will not charge a Guest for ordinary wear and tear or for damage for which the Guest is not legally responsible.

13. PERSONAL BELONGINGS

Guests are responsible for their own personal belongings, valuables, documents, money and electronic devices during their stay.

The Company is not responsible for loss, theft or damage to personal belongings except to the extent that such responsibility cannot lawfully be excluded or limited.

Guests should take appropriate precautions and should not leave valuable items unattended.

Any lost property discovered at the villa should be reported to the Company as soon as possible.

14. SAFETY & HOUSE RULES

Guests must comply with all reasonable safety instructions and house rules communicated by the Company.

Guests must not interfere with safety equipment, electrical installations, security systems, fire-safety equipment or other property infrastructure.

Children must be supervised by a responsible adult at all times.

Guests are responsible for ensuring that all members of their party behave safely and responsibly within the property.

Swimming Pool Rules

The swimming pool is provided for the enjoyment and use of registered guests of the villa.

For the safety and comfort of all guests, the following rules apply:

  • The swimming pool is used entirely at the Guest's own risk.

  • Children must be supervised by a responsible adult at all times when using or being near the swimming pool.

  • Guests must not run, push, dive or engage in dangerous or disruptive behaviour around the pool area.

  • Diving into the pool is strictly prohibited unless the pool has been specifically designed and designated for diving.

  • Glass bottles, glasses or other breakable glass objects are not permitted in or around the pool area.

  • Guests should use appropriate swimwear when using the pool.

  • Guests are requested to shower before entering the swimming pool, particularly after applying sunscreen, oils or similar products.

  • The use of the pool by persons under the influence of alcohol or other substances that may impair their judgement or coordination is strongly discouraged and may be prohibited where necessary for safety reasons.

  • Guests must not use the pool if they are experiencing a medical condition or other circumstance that may make swimming unsafe.

  • Any pool equipment, furniture or accessories must be used responsibly and must not be removed from the property.

  • Guests must keep the pool area clean and must not leave food, rubbish or other objects in or around the pool.

  • Pets are not permitted in the swimming pool unless expressly authorized by the Company.

  • Guests must immediately report any accident, injury, damage, malfunction or safety concern relating to the swimming pool to the Company.

The Company reserves the right to temporarily restrict or prohibit the use of the swimming pool where necessary for maintenance, cleaning, weather conditions, safety reasons or other circumstances beyond its reasonable control.

The Company shall not be responsible for accidents, injuries or damage resulting from failure to comply with these rules or from the Guest's negligent or unsafe behaviour, to the extent permitted by applicable law.

 

Quiet Hours

Guests are required to respect the peace, privacy and comfort of the surrounding area and neighbouring properties at all times.

In accordance with the applicable quiet hours, strict quiet hours apply during the following periods:

15:00 – 17:30
23:00 – 08:00

During these hours, Guests must avoid loud music, loud conversations, shouting, parties, gatherings, amplified sound, or any other activity that may disturb neighbours or other persons in the surrounding area.

The use of the swimming pool, outdoor areas and other facilities during quiet hours must be carried out with particular care and without creating noise or disturbance.

Guests are expected to keep television, music and other sound at a level that cannot be heard outside the villa during quiet hours.

Parties, events or gatherings that may cause excessive noise or disturbance are not permitted unless expressly authorized in writing by the Company.

Any serious or repeated violation of the quiet-hours policy may constitute a breach of these Terms & Conditions and may result in appropriate action by the Company, including termination of the Guest's stay without refund where legally permitted.

Guests are responsible for ensuring that all members of their party, including any authorized visitors, comply with these rules.

 

15. ACCESS TO THE PROPERTY

The Company or its authorized representatives may need reasonable access to the property during the Guest's stay for legitimate purposes, including maintenance, repairs, inspections, cleaning, emergencies or matters relating to the safety and proper operation of the property.

Except in an emergency, reasonable notice will be provided whenever practicable.

In an emergency or situation requiring immediate attention, access may be obtained without prior notice where reasonably necessary.

16. SERVICES, AMENITIES & AVAILABILITY

The Company makes reasonable efforts to ensure that the facilities, amenities and services described on the website are available and functioning properly.

However, certain services or amenities may occasionally be unavailable due to maintenance, technical problems, weather conditions, utility interruptions, circumstances beyond the Company's reasonable control or other operational reasons.

The Company will make reasonable efforts to restore affected services as soon as reasonably practicable.

No compensation will be due for temporary interruptions where such interruptions are outside the Company's reasonable control, subject always to any rights that cannot legally be excluded.

17. PHOTOGRAPHS & WEBSITE CONTENT

All photographs, videos, graphics, logos, designs, text, descriptions and other content appearing on this website are owned by or licensed to BESO PRIVATE MEMBER PC, unless otherwise stated.

Such content is protected by applicable intellectual property and copyright laws.

The copying, reproduction, downloading, distribution, publication, modification, commercial use or other unauthorized use of any photographs or other visual or textual content from this website is strictly prohibited without the Company's prior written permission.

In particular, photographs of the villas and properties may not be used for advertisements, listings, social media accounts, booking platforms, commercial purposes or any other public or private purpose without prior written authorization.

The Guest may not remove, reproduce, modify or use any Company trademarks, logos, branding or other intellectual property without prior written permission.

18. WEBSITE USE

The website is provided for the purpose of providing information about our villas and facilitating legitimate enquiries and reservations.

Users must not:

  • use the website for unlawful purposes;

  • attempt to gain unauthorized access to the website or its systems;

  • interfere with the proper operation or security of the website;

  • copy or reproduce website content without authorization;

  • use automated systems to scrape, reproduce or collect website content without permission; or

  • submit false, misleading or fraudulent information.

The Company reserves the right to restrict or terminate access to the website where necessary to protect its legitimate interests, security or intellectual property.

19. PHOTOGRAPHS & DESCRIPTION OF THE VILLAS

The photographs and descriptions displayed on the website are intended to provide an accurate representation of the villas and their facilities.

However, minor differences may occur due to changes in furnishings, decoration, landscaping, maintenance or other circumstances.

The Company reserves the right to make reasonable changes to furniture, equipment, decoration, landscaping or amenities where necessary, provided that such changes do not materially alter the nature of the accommodation.

20. GUEST RESPONSIBILITY & CONDUCT

The Guest is responsible for the conduct of all members of their party and for ensuring that they comply with these Terms & Conditions.

The Guest must respect the property, its surroundings, neighbours and applicable Greek laws and regulations.

Any serious breach of these Terms & Conditions may result in the termination of the Guest's stay, where legally permitted.

In such circumstances, the Company may seek compensation for any resulting loss or damage to the extent permitted by law.

21. COMPANY'S RIGHT TO CANCEL A RESERVATION

In exceptional circumstances, the Company may need to cancel a reservation, including where the property becomes unavailable due to serious damage, safety concerns, natural disasters, governmental restrictions, force majeure or other circumstances beyond the Company's reasonable control.

Where the Company cancels a reservation for reasons attributable to the Company and not to the Guest, the Company will provide an appropriate refund of amounts paid for the affected accommodation, subject to applicable law.

The Company will make reasonable efforts to notify the Guest as soon as possible.

22. FORCE MAJEURE

The Company shall not be liable for failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.

Such circumstances may include, without limitation, natural disasters, extreme weather conditions, fire, flood, earthquake, epidemic or pandemic restrictions, war, terrorism, civil unrest, governmental measures, strikes, utility failures, transportation disruptions or other events of force majeure.

Nothing in this clause shall limit any rights or remedies that cannot legally be excluded under applicable law.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Company shall not be liable for indirect or consequential loss, loss of profits, loss of enjoyment or other indirect losses arising from the Guest's stay.

Nothing in these Terms & Conditions shall exclude or limit liability for matters that cannot lawfully be excluded or limited under Greek or applicable European consumer protection law, including liability arising from death or personal injury caused by negligence where such exclusion would be unlawful.

24. COMPLAINTS

If a Guest experiences a problem during their stay, they should notify the Company as soon as reasonably possible so that the Company has a reasonable opportunity to investigate and, where possible, resolve the issue during the Guest's stay.

Complaints should preferably be submitted in writing and should include sufficient information to allow the Company to investigate the matter.

The Company will make reasonable efforts to respond to complaints promptly and fairly.

25. CONSUMER RIGHTS

Nothing in these Terms & Conditions is intended to deprive consumers of any mandatory rights or protections granted to them under applicable Greek or European Union law.

Where any provision of these Terms & Conditions conflicts with a mandatory provision of applicable law, the mandatory legal provision shall prevail to the extent of the conflict.

26. DATA PROTECTION & PRIVACY

Personal information provided by Guests in connection with enquiries, reservations and stays will be processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (EU) 2016/679 (GDPR).

For further information regarding the collection, use, storage and protection of personal data, Guests should consult the Company's separate Privacy Policy available on the website.

27. COOKIES

The website may use cookies and similar technologies.

Information regarding the types of cookies used, their purposes and the choices available to users is provided in the Company's separate Cookie Policy and/or cookie consent mechanism available on the website.

28. THIRD-PARTY SERVICES & LINKS

The website may contain links to third-party websites, payment providers, booking services, maps, social media platforms or other external services.

The Company is not responsible for the content, availability, security or privacy practices of third-party websites or services.

Any use of third-party services is subject to the terms and policies of the relevant third party.

29. APPLICABLE LAW

These Terms & Conditions and any contractual relationship between the Company and the Guest shall be governed by the laws of Greece, subject to any mandatory consumer protection provisions applicable to the Guest.

30. JURISDICTION

Any dispute arising out of or in connection with these Terms & Conditions or a reservation shall be subject to the jurisdiction of the competent courts of Greece, subject always to any mandatory jurisdictional or consumer protection rights that may apply to the Guest under applicable law.

31. SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision shall be modified or disregarded only to the extent necessary, and the remaining provisions shall remain in full force and effect.

32. AMENDMENTS

The Company reserves the right to update or amend these Terms & Conditions from time to time.

The version applicable to a reservation will generally be the version in force at the time the reservation is made, unless otherwise required by law.

The date of the latest update will be displayed at the beginning of these Terms & Conditions.

33. ENTIRE AGREEMENT

These Terms & Conditions, together with the booking confirmation and any specific written terms expressly agreed between the Company and the Guest, constitute the agreement relating to the relevant reservation.

In the event of a conflict between these Terms & Conditions and a specific written agreement or booking confirmation, the specific written agreement or booking confirmation shall prevail to the extent of the conflict.

35. SECURITY DEPOSIT

Upon confirmation of the booking, the guest is required to pay, in addition to the applicable advance payment, a €500 security deposit to cover any damage, breakage, loss or destruction that may occur to the villa, its equipment or property during the stay.

Provided that, following the guest’s departure and the relevant inspection of the property, no damage or loss is identified, the full €500 security deposit will be refunded to the guest.

In the event that any damage or loss is identified, the security deposit may be retained, in whole or in part, only to the extent necessary to cover the actual cost of repairing or replacing the damaged property. Any such deduction shall, where applicable, be supported by the relevant invoices, receipts or other legally valid supporting documents evidencing the cost of the repair, replacement or restoration.

If the actual cost of the damage is lower than €500, the remaining balance of the security deposit will be refunded to the guest. If the actual cost of restoration exceeds €500, the guest may be required to pay the difference, subject to appropriate documentation of the relevant costs.

The security deposit will be refunded following completion of the property inspection and, in the event of damage, following the determination and documentation of the actual restoration or replacement costs.

SHORT CANCELLATION POLICY

Cancellation Policy

  • 60 days or more before arrival: 100% refund.

  • 20–59 days before arrival: 50% refund.

  • 0–19 days before arrival: no refund.

The applicable cancellation period is calculated based on the scheduled arrival date stated in the booking confirmation.

Refunds, where applicable, will be made to the original payment method.

BOOKING ACKNOWLEDGEMENT

By completing a reservation, the Guest confirms that they have read and accepted these Terms & Conditions, including the applicable cancellation policy, occupancy requirements and property rules.
